Penalties For Dwi In Texas}

If you have recently been arrested for DWI in Texas and are looking for more information regarding how your case may be handled, please read on.

If this is your first DWI offense in Texas, it is considered to be a Class B Misdemeanor. You may receive a fine of not more then $2,000. You could receive time in the county jail of no less then 72 hours and no more then six months. This changes if there was an open container in your vehicle. In a case where there was an open container, you could receive time in jail of no less then 6 months. If the judge should issue community service, you will receive no less then 24 hours and no more then 100 hours.

One little known fact is that for most people convicted of their first DWI offense, will receive probation, generally for a period of one to two years. If probation is ordered, there are some general rules that are to be followed:

-The person convicted will be subjected to a drug and alcohol evaluation. If found to have a problem, further terms and conditions of probation will be administered through the Community Supervision Department.

– The person convicted will be required to attend and complete a DWI education class, no more then 180 days after the date of the conviction.

– The person convicted will be required to attend and complete a Victim Impact Panel to learn how the action of driving while intoxicated impacts other people.

– The person convicted will be expected to work daily, break no other laws and remain at the same address and place of employment unless they have notified the community supervision officer. He/She will also be expected to report weekly to the supervision office and pay and fines and penalties on time.

There may be other conditions ordered, depending on your case. For example, you may be ordered to attend alcohol treatment programs such as AA, pay restitution if there was an accident or you may be court ordered to not consume any alcohol for the duration of probation.

If this is your second offense in Texas, it is considered a Class A Misdemeanor. You may receive a fine of no more then $4,000. You could receive up to 1 year in the county jail or between 80 and 200 hours of community service. Almost all people convicted of a second DWI charge will be required to use a deep lung air device and may have their drivers license suspended for a period not less then 180 days or more then 2 years.

The third offense in Texas is a Third Degree Felony. If this is your third offense, you may receive a fine of up to, but not exceeding $10,000. You could receive a sentence of not less then 2 years or as many as 10 years in a Texas Department of Corrections facility. You’ll likely receive a deep air lung device, community service and have your drivers license suspended for up to two years.
